Get to Know Your Legal Rights

The Paternity Leave Act of 1996 (Republic Act 8187) gives married male employees up to seven calendar days of paternity leave with full pay, including mandatory allowances. “Calendar” days include weekends and holidays.

 

You can also claim paternity leave for miscarriages, so you can support your wife during a difficult time. 

 

It’s important to note that your employers can’t deduct paternity leaves from sick or emergency leaves. However, you can’t add unused paternity leaves to your total leave credits or convert them to cash.

Find Out if You Qualify for Paternity Leave in the Philippines

In the Philippines, you must be legally married to automatically qualify for paternity leave.

Check if you meet the requirements before making your claim.

 

  • Marital status: You need to be legally married. The law doesn’t cover cohabiting or romantic relationships.
  • Employment status: If you’re employed at the time of your child’s birth, you can get paternity leave—whether you’re a regular, probationary, or contractual worker.
  • Number of births: You can file for paternity leave four times, including births and miscarriages.

 

Some companies have more lenient eligibility requirements or give additional leaves as part of their benefits package. Ask your HR—they may be able to help!

Follow the Right Procedures for Filing Leave

Plan and coordinate with your HR and co-workers to prevent delays or problems at work while you’re on leave.

Take these steps to avoid delays or last-minute problems. By the time your wife gives birth, your paternity leave will be good and ready to go.

 

  • Give proper notice. Talk to your HR at least 30 days before the expected delivery date. For early or emergency labor, inform them as soon as possible. 
  • Submit documents. Some companies require a marriage certificate and a medical certificate confirming the pregnancy. 
  • Ask about schedules. Paternity leave should take effect immediately after delivery. However, if you plan to use some of it earlier or later, make special arrangements with your HR.
  • Plan with your team. Discuss who can handle your tasks while you’re away, and what you can do to ease the transition (i.e., sharing folders or informing clients). 

Explore Options for Extending Paternity Leave

Extended paternity leave gives new fathers more time to bond with the baby and adjust to new routines and responsibilities.

Need more time with your family? If your wife is employed, the Expanded Maternity Leave Law (RA 11210) allows her to transfer up to seven days of her maternity leave to you. You both just need to submit a request to your respective HR departments.

 

If you don’t qualify for paternity leave because you’re not married, you can apply for Solo Parent Leave under the Solo Parent’s Welfare Act. This gives you seven days of leave if you’ve been with the company for at least a year.
