Prepaid eSIM Terms and Conditions
The Globe Prepaid eSIM (“eSIM”) shall have a corresponding mobile number and an initial Prepaid Load.
By purchasing the eSIM Pack, the Globe Prepaid Subscriber (“Subscriber”), agrees to comply with and observe the Terms and Conditions below and all future amendments.
Terms and Conditions
- Pursuant to Republic Act No. 11934 otherwise known as the "Subscriber Identity Module 'SIM' Registration Act” and its Implementing Rules and Regulations set out in NTC Memorandum Circular No. 001-12-2022 (collectively referred to as "SIM Registration Act"), all new subscribers shall be required to register their SIM prior to activation thereof, in any of the following:
- (a) Globe’s designated online portal (“SIM Registration Portal”) accessible via this link - https://www.globe.com.ph/register-sim-card.html; or
- (b) Globe retail stores located nationwide
- (c) GlobeOne App
Failure to comply with the SIM Registration Act shall result in the automatic deactivation of the SIM Card and the imposition of pre-termination fees, when applicable.
- The Globe Prepaid Service (“Service”) may be used only if:
- (a) the Globe Prepaid eSIM is used with an eSIM-capable mobile device
- (b) the mobile device is not SIM-locked to networks other than Globe, and not blacklisted by Globe or by the National Telecommunications Commission (NTC) due to non-payment, theft, loss, or other reasons; and
- (c) Globe Prepaid Load is available in the account.
Globe shall have the sole discretion on whether a particular mobile device or eSIM may access the Globe network and use its Service. Globe’s records shall prevail in the event of any dispute on the eligibility of a particular mobile device for use with the Service.
If the customer proceeds with the purchase even if the device is locked to another carrier or has no available eSIM slots, the customer accepts full responsibility regarding the purchase and agrees that no refunds will be processed.
- The eSIM shall only be purchased via GlobeOne App, subject to applicable fees. All purchases are considered final once the customer proceeds and confirms the purchase. Once purchased, the customer shall be required to set up the eSIM in accordance with the instructions of Globe, and accomplish eSIM registration in accordance with the law. The purchase, set-up, registration of eSIM, and the activation of the plans will require a stable internet connection.
- Globe provides or sells mobile devices incidental to and not separately from subscriptions for the Service (i.e., as part of Globe Prepaid device bundles). Mobile devices purchased as part of Globe Prepaid device bundles or Phonekits are not replaceable nor is the purchase price refundable in the event of loss, damage or other analogous cases. Globe reserves the right to SIM-lock such mobile devices within a period as may be solely determined by Globe. Replacements or repairs of mobile devices purchased as part of a Globe Prepaid device bundle are governed by the Globe policy on returns and exchanges, and device manufacturer’s warranty.
- The Service requires the purchase, set up, registration, activation, and use of the eSIM. The eSIM whether included in a Globe Prepaid device bundle or Phonekit or not contains an initial prepaid load value. Once its initial prepaid load value is exhausted, continued access to the Service requires the re-loading of value by purchasing of Globe Prepaid Load through Globe Call/Texts Cards or via GlobeOneApp, designated online mobile apps, or from any Globe loading service, promo, or sales channel (collectively, “Globe Prepaid Load”). The specific features, terms and conditions of the particular Globe Prepaid Load shall govern the use and availability of the Globe Prepaid Load concerned. The Globe Prepaid Load cannot be used with Globe eSIM acquired under Globe’s Postpaid subscriptions.
- The eSIM shall expire and be permanently disconnected if:
- (a) The activated eSIM has no activity for a period of one (1) year from the date of last Globe Prepaid reloading; or
- (b) The activated eSIM has no activity for a period of One Hundred Twenty (120) days from reaching zero load balance or promo expiration with zero load balance
- (c) In the event the eSIM is registered by a foreign national visiting as a tourist, the eSIM shall automatically expire thirty (30) days upon registration.
- All outgoing calls and text messages, mobile data used, or Globe Prepaid promos registered to using the eSIM will be charged according to Globe’s Prepaid Rates prevailing as of the time that such activities were made, including applicable toll charges and taxes. International calls, text messages, or use of mobile data shall be charged at the exchange rate prevailing as of the time that such activities were made.
Globe reserves the right to change Prepaid Rates without prior notice, upon effectivity of the NTC Order approving such change(s). Globe Prepaid promos are priced separately and have their respective validity periods and terms and conditions of use.
- The Subscriber shall be responsible for securing, safekeeping, and storing his/her/its mobile device(s), eSIM, and Globe Prepaid Load, as well as monitoring and using any Globe Prepaid Load in his/her/its account, and protect these things from loss, theft, damage, or unauthorized use. The eSIM has an assigned unique Personal Identification Number (PIN) and Personal Unlocking Key (PUK) codes that can be claimed through Globe Stores which the Subscriber should keep safe and secure at all times. The PIN codes are security numbers that must be keyed into the eSIM in order to explore mobile device services and other features; the PUK codes are security numbers used to unlock the eSIM that have been blocked due to erroneous input of PIN codes. Globe does not store backup copies of the PIN and PUK codes issued with eSIM, and therefore cannot issue or generate backup or replacement PIN and PUK codes.
- The use of the Service (including, but not limited to, calls or messages to wrong numbers, fax tones, or answering machines; use of mobile apps; use of the mobile device as a Wi-Fi hotspot; making video calls; or registration to content promos) shall be the sole responsibility of the Subscriber, and all activities made thereto shall be presumed to be authorized by the Subscriber. Globe will not entertain any claim for rebate, return, or refund of Globe Prepaid Load on account of unauthorized use of the eSIM. The Subscriber acknowledges and agrees that it is inherent in the nature of a prepaid mobile service that details or an itemized billing of calls made, text messages sent, or mobile data usage in connection with the eSIM cannot and will not be provided by Globe.
- The eSIM or Globe Prepaid Load card is non-refundable. In the event of loss, theft, or damage due to misuse, mishandling, or neglect, the Subscriber may request for replacement, subject to Globe’s business policies, fees, and requirements. Claims of defects in the eSIM or Globe Prepaid Load, if any, shall be entertained if brought to Globe’s attention within seven (7) calendar days from the date of purchase and only if there has been no prior usage and if it has missing, incomplete, or unclear numbers (including PIN or PUK codes). All replacements due to defects shall be subject to the investigation by and sole discretion of Globe upon presentation and validation of required documents.
- The Subscriber agrees not to use the Service, mobile device(s), eSIM, or Globe Prepaid Load for any unlawful, fraudulent, illicit, or abusive purpose. Globe hereby reserves the right to suspend, refuse to reconnect, terminate, or disconnect the Service to any Subscriber who shall exhibit abusive usage as determined by Globe at its sole discretion. Globe also reserves the right to file the appropriate legal action against the erring Subscriber and to charge the appropriate fees, if any, as well as to exercise any other available remedies to protect Globe’s interest.
The Subscriber agrees not to engage in the following activities:
Unauthorized Activities
- (a) Resale or any commercial use of the Service, without the prior express written consent of Globe;
- (b) Utilization of the Service in bypassing or in activities that tend to bypass the Globe network, billing, and/or traffic routing;
- (c) Use of the Service in prohibited services like callback, dial back, unauthorized audio text, international and national simple resale (ISR/NISR), international revenue share fraud (IRSF), premium rate service (PRS) fraud, Internet fraud, hacking, text spamming, text flooding, text hoax, and other similar services;
- (d) Tampering, altering, modification, or unauthorized programming of the eSIM or its digital reference; or
- (e) Other similar or analogous activities as determined by Globe.
Illegal Activities:
- (a) Any activity that is contrary to morals and/or public policy, or which violates any ordinance, law, decree, order, regulation, or treaty, including those penalizing identity theft/usurpation;
- (b) Any violations of the SIM Registration Act, Cybercrime Law, Data Privacy Act, Intellectual Property Code, and Anti-Child Pornography Act; or
- (c) Other similar or analogous activities/violations.
The Subscriber agrees to be liable to Globe for any and all damages resulting from the commission, tolerance, negligence, or abetting the commission of any of the above Unauthorized and/or Illegal Activities. In addition, the Subscriber agrees to indemnify Globe for any and all compensation fees on account of any of the above Unauthorized and/or Illegal Activities and/or unauthorized commercial use of the Service. The compensation fee is payable, without any limitation from the time the Unauthorized and/or Illegal Activities occurred or are committed until the actual cessation thereof. A penalty equivalent to one hundred fifty percent (150%) of the computed revenue losses shall be charged against you if proven accountable for such Unauthorized and/or Illegal Activities. For this purpose, the Subscriber consents to provide Globe the right to fully access, without the need of court order, to the relevant books and all other records held by the Subscriber or in his/her/its possession in order to ascertain the volume of traffic and the total amount of compensation fee payable. In the absence of said record, Globe shall have the sole discretion in the determination of the bypass compensation.
The Subscriber further agrees to fully indemnify and hold Globe, its directors, officers, employees, agents, and injured third parties free and harmless from any liability, suit, or damage arising from or connected with the commission of Unauthorized and/or Illegal Activities.
The Subscriber authorizes Globe and consents to supply any and all information relative to the subscription to the Service, requested by any law enforcement or government agency/ies, or other private entities within the limits provided for by law. In such case, the Subscriber, hereby irrevocably and unconditionally waives any and all relevant remedies under the law, including but not limited to the right to claim damages against Globe.
- Except as otherwise provided herein, Globe does not expressly or impliedly warrant the condition or merchantability of the information or communication services provided through the Service for any particular use or purpose. All information and translations are provided on an “AS IS” basis. Globe’s liability, if any, for the loss or damage caused by defects in the performance or non-performance of the Service shall be limited to a credit equivalent to the amount paid for the eSIM or the Globe Prepaid Load.
- Globe shall not be liable for any loss, damage, costs, or compensation, including any injury or damage to the Subscriber or any third party, arising directly or indirectly from or in connection with the use or provision of the Service, including the following:
- (a) Any delay, interruption, or termination of the Service, whether caused by administrative errors, system or server errors, technical, mechanical, electrical, or electronic fault, malfunction, difficulty or combination thereof, or any other reason or circumstances beyond Globe’s control (including, but not limited to, acts of God, strike, labor disputes, fire, disturbance, earthquake, typhoon, lightning, atmospheric conditions, any interference or damage by third parties, action of or orders from the government, or any change in legislation);
- (b) Any inaccuracy or omission, lack of clarity, interference in, misdirection, or destruction of any information transmitted to or from the Subscriber, howsoever caused;
- (c) Theft or unauthorized use of the eSIM or any loss, costs, damages, or compensation incurred by or payable to any third party by the Subscriber;
- (d) Transmission or non-transmission of any illegal, false, misleading, derogatory, libelous, obscene or vulgar messages or information; or
- (e) Any network congestion or service degradation for reasons not within the control of Globe.
- The intellectual property rights to or over the content (including, but not limited to, information, communications, software, images, videos, and/or sounds contained on or available through the Service) and any of its parts provided by Globe, its content providers, and/or third party licensors shall belong to Globe, its content providers, and/or third-party licensors, as the case may be. All rights are reserved. The contents of the Service cannot be reproduced, modified, transferred, distributed, republished, downloaded, posted, or transmitted in any form or by any means including, but not limited to, electronic, mechanical photocopying or recording. Without prejudice to the foregoing, the Subscriber agrees that the material and content contained within or available through the Service may not be used or distributed for commercial, unlawful, fraudulent, illicit, or abusive purposes, or in relation to Unauthorized and/or Illegal Activities as defined in these Terms and Conditions.
- The Subscriber agrees and consents to the collection, disclosure, analysis, processing, and/or use, either by Globe or by third parties on behalf of Globe, of his/her/its personal data, including personal information, usage, or billing data volunteered by or gathered from the use of the Service by the Subscriber, for research, marketing, and improving products, services and other purposes. Specifically, the Subscriber agrees and consents that Globe and its subsidiaries and/or affiliates (such as but not limited to Innove Communications, Inc., Adspark, Inc., G-Xchange, Inc. [GCash], Globe Fintech Innovations, Inc. [Mynt], Fuse Lending, Inc. [Fuse], or other Globe Group Entities and Globe partners, may use the Subscriber’s personal information and data (either under control of or processed by Globe Group) to:
- (a) Manage the Subscribers’ accounts, carry out customer care activities and support staff training (including but not limited to monitoring of calls made to Globe hotlines, or of e-mails or text or electronic messages sent by the Subscribers to Globe), and to perform after-sales transactions (such as but not limited to promo upgrades or revisions);
- (b) Monitor the quality and security of the Globe network and test and maintain Globe’s IT systems;
- (c) Analyze Subscribers’ frequency of use of the Service for marketing purposes including but not limited to the data usage, calls, and messages that the Subscriber sends and receives;
- (d) Send to emergency services (if Subscriber makes an emergency call), including Subscribers’ approximate locations;
- (e) Contact Subscribers with marketing messages such as cross-selling or upselling of current and new products/services, commercial and promotional advertisements, loyalty and rewards programs, and other broadcast push messages;
- (f) Perform credit scoring and sharing with Globe Group and Globe partners; and
- (g) Provide government requirements for the social good.
Furthermore, the Subscriber understands and agrees to the following:
- (i) Globe does not include Subscriber’s details in any directory or directory-enquiry service. If the Subscriber wants to have his/her/its information included in these services, the Subscriber should contact Globe;
- (ii) Globe and/or its subsidiaries and/or affiliates may contact the Subscriber via any of the following channels: text, call out, e-mail, USSD, and other digital assets, such as online or mobile apps;
- (iii) During roaming, Globe and its roaming partner in the storage, treatment, and transfer of the Subscriber’s personal data may be subject to regulations different from the regulation in the Philippines.
- (iv) The Subscriber may amend, update, revise, or delete certain parts of the personal data provided to or collected by Globe at any time via apps, e-mails, phone calls, or visits to Globe stores;
- (vi) The Subscriber may also take all of the personal data provided to Globe if he/she/it opts to leave the Globe network (this may be provided via a PDF file upon request);
- (vii) Should the Subscriber not want to receive marketing or other messages from Globe and/or its subsidiaries and/or its affiliates, or other organizations, the Subscriber must immediately contact Globe through the Globe website (www.globe.com.ph) or by calling 211 via mobile device or (02) 730-1000 thru a landline;
- (viii) By using the Service, the Subscriber agrees and consents to the disclosure and the processing/analyzing, either by Globe or by third parties on behalf of Globe, Globe Group, or Globe partners, of personal data, including location profiling and interest profiling based on sites visited, for marketing and other lawful purposes. For this purpose, the Subscriber acknowledges and agrees that Globe or by third parties on behalf of Globe, Globe Group, or Globe partners may send commercial and promotional advertisements, market research surveys, and other broadcast push messages with regard to Value Added Services (VAS) and content;
- (ix) The provisions of the Globe “Fair Use Policy for Mobile and Data Service” as appearing on the Globe website (www.globe.com.ph) governs the use of the Service, the eSIM, or the Globe Prepaid Load; and
- (x) The Subscriber’s use of the Service is subject to Globe’s (including its subsidiaries and/or affiliates) Data Privacy Policy as found on https://www.globe.com.ph/privacy-policy.
- Globe shall not be liable to the Subscriber or any third party, directly or indirectly, for any direct, indirect, consequential, or other damages, losses, costs, compensation, or liability resulting from the use, misuse, or abuse of the Service, eSIM, or Globe Prepaid Load, or any act, failure, error, loss, damage, or theft pertaining to the said products and services, whether in whole or in part, or for any loss, damage, theft, neglect, mishandling or misuse/abuse of mobile device(s).
- Globe reserves at its sole and absolute discretion the right to amend these Terms and Conditions at any time, with or without prior notice. It is the Subscriber’s responsibility to regularly check any changes to these Terms and Conditions available on the Globe website (www.globe.com.ph) from time to time. These Terms and Conditions shall be in effect from the date of availment of the Service, and the Subscriber’s continued use of the Service or eSIM constitutes acceptance of the updated or revised Terms and Conditions, if any.
- The Subscriber’s use of the Service, eSIM, Globe Prepaid Load, as well as any special promos availed of by the Subscriber, including all the updates are governed by its respective Terms and Conditions. The Subscriber shall be responsible for reading the said Terms and Conditions as posted on Globe's website, official social media accounts, or as published in newspapers of general circulation and hereby agrees to be bound by them.
- The foregoing Terms and Conditions shall be construed in accordance with Philippine Law, including matters of enforcement and performance. All suits involving the Service shall be filed exclusively with the proper courts in Taguig City, Philippines.
